The Contractor shall provide exclusively administrative support, document preparation, strategic case organization, and operational assistance related to the preparation of an EB2-NIW (Employment-Based Second Preference – National Interest Waiver) immigration petition, according to the scope, pricing, timelines, and specifications outlined in the approved commercial proposal.
The Contractor does not provide legal services, legal advice, legal opinions, or legal representation. The commercial proposal and summary table are incorporated into and form an integral part of this Agreement.
Services may include:
- Initial case strategy review
- Resume/CV evaluation
- Evidence checklist and organization
- Review of supporting documentation
- Guidance regarding recommendation letters
- Petition package organization
- Administrative case support
- Business plan preparation
- Support with document preparation
- Shipping expenses
- Requests for Evidence (RFEs)
- Case assembly coordination
Unless specifically agreed in writing, this Agreement DOES NOT include: USCIS filing fees; Premium Processing fees; Attorney fees; Legal representation; Legal advice or opinions; Publication or media services; Patent filing; Expert opinions; Credential evaluations; Translation services; Government fees; Appeals; Litigation; Academic publication; Third-party reports. These remain solely the Client's responsibility.
The Client authorizes payment processing according to the agreed payment schedule. Installment payments are a financing convenience and do not correspond to divisions of service stages.
By signing this Agreement, the Client authorizes immediate commencement of services.
Once documents or petitions are submitted to USCIS or governmental agencies, modifications may be limited and may require additional work, revised submissions, or additional fees.
The Client is solely responsible for the accuracy, authenticity, and completeness of all information and documents provided. The Contractor shall not be responsible for delays, NOIDs, denials, or unfavorable outcomes arising from inaccurate, incomplete, or omitted information. The Contractor does not independently verify document authenticity.
Case preparation depends substantially on Client cooperation. The Client acknowledges that EB2-NIW petitions are evidence-based and may require academic records, employment history, awards, publications, media exposure, recommendation letters, and supporting evidence.
If the Client remains inactive or fails to provide requested documentation for more than thirty (30) consecutive days, services may be paused. Extended inactivity may affect preparation timelines.
The Client acknowledges that recommendation letters may require multiple revisions and frequently depend on third-party participation. The Contractor does not guarantee participation, availability, or response times of recommenders.
The Client agrees to promptly communicate relevant changes including employment changes, new awards, publications, immigration changes, address changes, educational updates, and relevant historical information.
Services are customized and individualized. Payments reflect administrative work, strategic planning, document preparation, operational costs, and team involvement.
The Client may cancel services through written notice. Upon cancellation: future scheduled payments shall cease; services shall terminate; previously paid amounts are non-refundable due to work already initiated and resources already allocated.
Before initiating disputes or chargebacks, the Client agrees to contact the Contractor first. The Contractor may provide contractual acceptance, communication records, activity records, and evidence of services initiated.
Late payments may result in administrative fees, interruption of services, and preparation delays.
The Client acknowledges that approval of an EB2-NIW petition is entirely discretionary and determined solely by USCIS. No approval, immigration benefit, or processing timeline is guaranteed.
The Client understands USCIS may evaluate substantial merit, national importance, ability to advance the proposed endeavor, and benefit to the United States. Final determinations belong exclusively to government authorities.
USCIS may issue RFEs, NOIDs, or additional documentation requests. Responses to RFEs, NOIDs, motions, appeals, refiling efforts, or additional government requests are not included unless expressly agreed in writing. Additional fees may apply.
Preparation timelines depend on Client responsiveness, documentation complexity, third-party participation, and outside providers. Specific filing dates are not guaranteed.
Any initial case review, eligibility assessment, profile analysis, or discussion regarding case strength is informational and strategic only. Such discussions do not constitute legal advice, legal opinions, or guarantees of approval.
Substantial changes in professional profile, immigration strategy, field of work, or case structure may require scope revisions, timeline adjustments, and additional fees.
The Contractor is not a law firm and does not provide legal services. The Contractor does not represent clients before USCIS, does not provide legal advice, does not issue legal opinions, does not act as an attorney, and does not establish an attorney-client relationship. If legal representation becomes necessary, the Client must independently retain licensed legal counsel.
The Contractor's total liability shall not exceed the amount paid by the Client. No immigration outcome is guaranteed. The Contractor shall not be responsible for changes in laws, USCIS policies, governmental delays, or events outside its control.
Client information shall remain confidential and used exclusively for purposes related to contracted services. The Client authorizes secure storage and processing of information for service execution.
Official communication shall occur exclusively through approved company channels. Communications may be recorded. Services and communication shall occur during company-established business hours.
Cases remaining inactive for more than ninety (90) days may be administratively archived. Case reactivation may require additional administrative fees.
Disputes shall be resolved through binding arbitration in Windermere, Florida. Electronic signatures shall have the same legal validity as physical signatures. The Client acknowledges: understanding the nature of services; that services begin immediately; that no approval is guaranteed; the cancellation policies; and that services are administrative and operational only and do not constitute legal representation or legal advice.
